When parents divorce or separate one of the most important things to think about is who gets custody and the visitation rights to the children from the relationship. Divorce splits the ties between husband and wife, custody breaks the bonds of parenting. It is important for to understand that has a right to a continuing relationship with each parent.

Although the tendency is changing, it is the case that the typical judicial attitude towards custody usually favors women. For whatever reason, it has been the precedence set in the past and traditionally many judges find it difficult to change their ways. Nevertheless, modern attitudes are changing and fathers are starting to enjoy a more significant role as parents. When a father has been given visitation rights it is very importantthat these rights are not interfered with.

In an ideal situation parents cooperate to see that the kids spend a maximum amount of time with each parent. Sadly, it often ends up with the non custodial parent (usually the father) spending very little time with the children, and many bitter arguments about delayed visits and children not being ready on time. In order to avoid these situations, many judges insist that the parties to devise a considerably detailed custody schedule (known as a parenting agreement or parenting plan) which sets out the visitation schedule and outlines who has responsibility for decisions affecting the children.

If you have agreed on a parenting plan which has been ratified by the court in the final custody decision then you already have a visitation schedule that can be enforced by law. Even though there may be times that you might have to compromise on visitation dates, such as when someone gets sick, or certain appointments need to be made, or other special circumstances consistent interference with visitation may even be cited as a case for change of circumstances and used to modify the custody decision and even have custody reversed.

To begin with, visitation schedules are simply trials. Neither parent knows how the relationship with each child may change and develop. In some cases parents modify the parenting plan without going to court as the needs of the child change over time. Later, however, if either parent refuses to comply with the new arrangement, the other person may not be able to enforce it unless the court has approved the modification. Therefore it is most advisable to get any modifications approved by the court.

For the non custodial parent, ensure that your parenting schedule is very precise about your visitation rights, including holidays, the amount of hours and the places you can see your children. Most states consider it a crime to interfere with custody and visitation rights. This crime is commonly referred to as "custodial interference." In most states, the parent deprived of custody may sue the taker for damages, as well as getting help from the police.

Some fathers make the mistake of holding back their child support payments because the mother has stopped him from seeing the children on occasions, or has made it difficult for him to spend time with them. Custody and visitation should not be confused with child support. Despite what the mother may do, you must always pay child support. You may face heavy penalties for failing to meet your obligations. Every parent has the duty to support their children.

One major study revealed a significant link between custody and visitation arrangements, the amount of antagonism between parents and the payment of court-ordered child support. Fathers continued paying child support more often when they spent regular and frequent time with their children, including daytime and overnight stays. , the less apt they were to keep paying support.
